Can Truck Drivers Use CBD Oil?

Cannabis products are gaining popularity in the US owing to their medicinal as well as recreational properties. 

CBD oil, in particular, has garnered more limelight than any other product thanks to its multiple uses. Just a small quantity of this oil can relieve anxiety and help you get a good night’s sleep.

As most truck drivers face these challenges regularly, CBD oil or its products seem like the perfect solution for them. But as a hemp or marijuana extract, is CBD oil legal? Can its consumption or possession get a driver into trouble? A better understanding of CBD and what the law says about it should help us answer these questions more convincingly. 

What is CBD oil?

Cannabis plants like marijuana and hemp contain more than 113 cannabinoids, which are natural compounds. Among these, CBD and THC are widely famous for their therapeutic properties. CBD is a non-psychoactive compound, whereas THC can cause euphoria. Consumption of CBD oil in any form cannot get you high because its chemical structure is different. It is interesting to note that CBD is found in both hemp and marijuana plants, but only the hemp extracted CBD oil is legal. That’s mainly because it contains less than 0.3% THC, and the user will not experience any intoxication. 

Research thus far has shown that regular and small doses of CBD oil offer a wide array of health benefits. It is a great pain reliever, helps control stress and anxiety, cures insomnia, migraine and other chronic ailments. CBD works in our body to create better harmony, which enhances our energy levels. Truck drivers often seek medication to manage occupational hazards like severe back issues, muscle pain, and stress. CBD oil is a reliable alternative that can cure such symptoms without any noticeable side effects. But if this ingredient is detected in the drug screening, the drivers are at the risk of losing their jobs. 

Is CBD oil legal?

The simple answer to this question is yes, CBD oil is legal in many states in the US. However, for the oil or tincture to be legal, the content of THC in it should be less than 0.3%, irrespective of whether it is extracted from hemp or marijuana plant. Separating THC from CBD is a complex process, and even through the most stringent process, some traces of this psychoactive compound will remain in the CBD extract.

 That’s the reason why different CBD oils mention different percentages of THC, which many times may be above the permitted limit. So, are all CBD oils legal? No, many of them may not pass the test. Just a few selected brands may qualify as legally provided; they are extracted from hemp plants. This means that you need to do a lot of research about a particular brand of CBD oil before using it. 

Can truck drivers use CBD oil? 

We cannot answer this question with a simple yes or no. Truck drivers can use CBD oil provided it is considered legal by their state and their employer. As THC is illegal, even the slightest content of this ingredient in CBD oil will make it illegal. That means the product you choose to use should be extracted from hemp and not from marijuana. Such confusion creates quite a dilemma in the minds of truck drivers.

The federal government considers all kinds of CBD products as illegal, including CBD oil. An interstate driver, in this case, cannot use CBD oil while driving because he has to abide by the federal law. On the other hand, if a driver operates within a state where CBD is legal, he can use CBD products. Different state governments have different approaches when it comes to the legality of CBD, and thus, it is crucial to be well informed about the law.

Truck drivers are randomly taken up for drug tests, and many have failed these tests for using CBD oil. The fact that drug screening tests are very sensitive; they do not differentiate between the traces of THC present in CBD oil and what is derived from marijuana. Thus drivers should always keep their employers informed if they are consuming CBD oil.
