Discover If There is Proper Coverage

The first thing you are going to have to do is discover if the opposing parties involved in the accident have the proper liability coverage. For instance, if a motorist hits you, you are going to have to find out if that driver has liability insurance. If a defective product injures you, you will have to contact the manufacturer and find out if they have the proper coverage. This is important because if the opposing party doesn’t have insurance it is likely that you might not be able to collect anything. Sure, it is illegal to drive without insurance, but you would be surprised to learn how often this happens.

You always have the option of using the opposing party, but do they even have anything to take and are your injuries significant enough?

The Claims Adjuster

Once the personal injury claim has been made, you will be contacted by a claims adjuster. The individual will want to get your side of the story. What actually happened and how it happened. The claims adjuster will also want to know the extent of your injuries and how much emotional damage that you experienced as a result of the injury. Keep in mind that during this stage you do not need to defend your claims. You just want to remain calm and relay your side of the facts as they happened. It doesn’t hurt to say that the opposing party was careless while you were being as careful as you good.

Negotiating The Settlement

In most basic cases it will be up to the claims adjuster to calculate the damage from your injury. He or she will take into account medical expenses, lost wages, and the time that you are going to be out of work. This settlement will be presented to you, but it doesn’t mean that you have to accept it right away. In fact, even if the offer sounds good, you should probably avoid accepting right off. Claims adjusters are authorized to offer different settlement amounts and they usually start right at the very bottom.

Always Review The Settlement

The adjuster will probably leave the settlement with you for a few days and give you time to think it over. However, if you are really just unaware if the amount is fair or not, you should speak with an attorney. Make sure you go to one that specializes in these types of cases. Just remember that talking to a lawyer isn’t the same thing as hiring one. There are plenty of personal injury lawyers out there that will be happy to provide free advice.
